We Won! Common Sense Prevails in ‘Bus Dad’ Case.

Today, the BC Court of Appeal released their reasons for judgment in my case against BC’s Ministry of Children & Family Development. In short, the Court allowed our appeal and we won. The Court declared the order made by the Director (MCFD) “unauthorized and of no force and effect.” ( full text of judgment ) [Latest media coverage can be found at the bottom of this post] But before I talk about it, I want to express profound gratitude to the hundreds of people who have donated to the GoFundMe and Facebook fundraising campaigns. Since I sold our minivan in 2015, I’ve rented our condo’s assigned underground parking spot out to a friend for about $150/month. That’s $1800/year in additional income, simply for not having a car. It’s been great. But recently I had to re-list that spot for rent. Our strata council (HOA) was cracking down on those of us who rented our parking spots to people who didn’t live in the building. [Unfortunately, the VR tour referenced in this post is no longer available, as the provider, Van Chernen Real Estate Photography, went out of business. I’ve been unable to reach them, despite repeated attempts. My apologies.] One of the more frequent requests I get from readers of my 5kids1condo.com blog is for video tours of the condo. The Georgia Straight did a video tour a couple years ago and bits of the condo appear in videos from time to time, but we’ve never done something truly comprehensive. Wide open living room, suitable for activities from painting to dance. Recently I met the two young men behind Van Chernen. They do virtual reality (VR) tours of new real estate listings. I’m Adrian Crook, a single father of five kids living in a condo in downtown Vancouver and an Independent Vancouver City Council candidate in this October’s election. In April of 2017, British Columbia’s Ministry of Children and Family Development (MCFD) began an investigation of my family based on an anonymous report of my children riding the bus to school together. For two years up until that point, I engaged in a long and careful process of riding the bus with my four oldest kids, training them to take the city bus to their school. Teaching them transit is an effort to instill independence, model sustainability and increase their safety. My eldest daughter and I, on the bus together. I certainly didn’t expect to have the Autumn we had in 2017. After I wrote Very Superstitious: How Fact-Free Parenting Policies Rob Our Kids of Independence in early September, a media maelstrom broke out. To recap that article quickly, British Columbia’s Ministry of Children and Family Development (MCFD, equivalent to CPS in the USA) intervened to tell me my four oldest kids could no longer ride the bus to school together, nor be left alone anywhere at any time. This after I’d spent the better part of two years, without incident, teaching them how to ride the bus, and despite a mountain of evidence supporting bus transport as the safest means of travel – beyond car, bike, or even walking. The MCFD even acknowledged that there was no negligence on my part and said I’d went, “above and beyond” what could be expected of any parent training their kids to take transit. I’ve been teaching my oldest kids (ages 7, 8, 9 and 11, as I write this) how to take the city bus to and from their school for the last two years. It’s gone unequivocally well, with the kids slowly progressing from riding with me for the entire trip, to being on their own for part of it, to riding entirely on their own. One of my proudest moments in this journey came when we received an email from one of our fellow bus riders, praising the kids’ skills and behaviour on transit. I’ve happily invested countless hours riding the bus with them, coaching them and answering their questions to ensure they’re capable transit riders. I’ve done this not because I’m too lazy to drive them or too cheap to own a car ( we’ve been car-free for two years now), but because I aim to raise capable, independent humans who prioritize sustainability and safety above the perceived convenience of cars. An interesting thing happened last week. Perhaps a milestone in notoriety for this site, or merely a part of its evolution. I’m still deciding which. CTV, one of Canada’s national broadcasters, airs “The Social,” one of those midday panel chat shows. It’s not the biggest outlet to cover 5K1C (this month we’ve been featured on the front page of MSN.com , Good Housekeeping and in the Daily Mail ), but it is the first TV show to feature us without trying to contact me beforehand. The Social’s hosts debate the merits of the 5K1C lifestyle. So it appears we’re literally talk show fodder now. The Social’s panelists spent several minutes or so debating the merits of the 5K1C lifestyle (segment begins 8 mins in). The Social’s lone male host adopted a contrarian angle.
